Recent developments regarding collective bargaining : opportunities and challenges

Abstract

As labour law is constantly evolving, the question of its adaptation to new challenges becomes increasingly relevant. A few examples of these challenges are the improvement of working conditions, the introduction of more flexibility and autonomy to organise work and the increase of productivity. Collective bargaining is regarded as a possible way to meet these challenges and, at the same time, to achieve a fair balance between the interests of both the employers and the employees. In the last years, collective bargaining is increasingly organised at lower levels. With this trend, discussions arose about which role should be assigned to enterprise collective bargaining. Even though collective bargaining at lower levels offers opportunities, it is important to take the challenges into account. In this paper, I will focus on two countries that will serve as an example, more specifically Belgium and France. For Belgium, I will discuss the law on feasible and manageable work of 5 March 2017. For France, I will analyse the ‘loi travail’ and the Labour Code. |
