Abstract

|
This paper addresses the problems that affect the definition of the notion of general interest and its interrelation with individual freedom and other values. The author is committed to the rescue of the notion of common good to provide a coherent face the idea of general interest that is more consistent with the criterion of fair justice. Finally, it assesses the implications of recognition in Cuban of general interest as an axiological criterion applicable to the interpretation of contracts and draws some guidelines for its better application to the contractual intelligence process. |
