| In the more extensive version of this contribution (“Some Comments on Supreme Court 29 May 2020, Also in the Light of Supreme Court 23 November 2018 and Case C-815/18. On Orwellian Protection, Freedoms and Limitation Thereof”), the author makes some comments on the decision of the Dutch Supreme Court of 29 May 2020 regarding the escape-clause of Article 8, 4 of the Rome 1 Regulation, as well as on the opinion given by the Advocate General at the Supreme Court, in the light of previous case law including Supreme Court 23 November 2018, Court of Justice of the European Union Schlecker (C-64/12) and Court of Justice of the European Union Nogueira (C-168/16 and C-169/16) as well as the, by then, pending FNV-Case C-815/18 in which an opinion had already been delivered by the Advocate General at the Court. This version is an updated, short version of the more extensive paper. |
