Abstract

| The purpose of this publication is to assess normative content of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) in reference to children’s legal situation in the field of personal data protection and implementation the principle of the child's interest. The article presents the discussion on the principle of the best interest of the child in EU legislation. Particular emphasis was placed on the interpretation Regulation’s provisions governing the terms of consent concerning children’s personal data processing and their comparison with national regulations. It was pointed out that it is necessary to analyze principles and range of application of these provisions on the basis of various legal grounds. |
