The article examines two projects that may have an impact on the coherency of the future European private law. These are the Draft Common Frame of Reference (DCFR) and the private enforcement of European competition law. The article presents backgrounds of both projects as well as their mutual influences and divergences. Among other comparisons, this article presents a comparison of the emerging rules for damages actions for competition law infringements and the rules of the DCFR on non-contractual liability.. |
